Our Wedding Contract


It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

Description

This agreement covers the engagement of Pinner Wedding Photography to take wedding photographs at the wedding of _____________ and _____________ at _____________ on __________________.

1. Services Included

Pinner Wedding Photography will provide the following services as part of this agreement:

Two photographers, where the lead photographer will be ______________ and the second photographer will be ______________

  • One photographer to start at <location> at or after hh:mm on dd/mm/yyyy to photograph the bride’s preparation. This will generally be reportage photography although some shots may be posed
  • The second photographer to start at <location> no later than 45 minutes before the start of the ceremony to photograph the guests arriving, the wedding rings, the groom & best man, and the bride arriving

Both photographers will be present during the Ceremony

Both photographers will be present at <location> for the reception covering the bride and groom arriving through to the First Dance (the end time is usually about 21:00 but we can extend up to 23:00 at no extra cost if there are specific activities where photographs are required)

Formal group photographs and formal photographs of the bride & groom will be taken either at the wedding venue or the reception venue as agreed prior to the wedding day

After the wedding the images will be assessed by the photographers and technically unsuitable images (e.g. out of focus, too dark etc.) will be discarded

The remaining images will be subject to post production (at the discretion of the photographers) that may include cropping, exposure adjustment, colour balance adjustments, removal of extraneous items, perspective adjustment etc.

Pinner Wedding Photography will create a Wedding Album to the agreed design and specification containing images selected by the Bride & Groom

High Resolution copies of the images used in the wedding album will be provided on a USB Flash Drive

2. The Booking Fee

The Booking Fee of £200 secures the time and services of Pinner Wedding Photography for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation.

Cancellation less than 12 weeks before the wedding will result in the payment in full. All cancellations must be in writing. Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time.

3. Payments

The total fee payable is £_____ .

Following payment of the Booking Fee the balance of fees due are to be paid as follows: 

£_____ payable 14 days prior to the wedding which, along with the booking fee, represents 75% of the total due

£_____ payable on collection of delivery of the wedding album

No photographs/images will be delivered until all payments due have been paid in full. Payment for additional images, prints or albums to be made when they are ordered.

4. Display

Pinner Wedding Photography may display any photographs included in this contract in their studio, web site, portfolio, literature, display areas, exhibitions, competitions, advertising or slide shows.

5. Images

All image sizes are nominal. The Photographers will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.

6. Retouching

Additional retouching, digital manipulation and artist finishing over and above that described in Section 1 above is available to the Client at an additional cost.

7. Image Availability

No images will be made available until they have been seen by the bride and groom. The images will be available to the bride and groom after the honeymoon (normally two weeks after the wedding day).

8. Wedding Albums

The Bride & Groom will be invited to attend a review session with the lead photographer to select the images to be used in the wedding album. The wedding album style will be agreed with the bride & groom but the final layout is the responsibility of the lead photographer. Minor changes to the final layout requested by the Bride & Groom are included in the overall price but significant changes (defined as those taking more than three hours) may incur an extra charge.

Changes of wedding album type, size or number of pages can be made at any time before the album layout is started but may affect the overall price. Any changes shall be treated as an extension of this contract and no responsibility for error will be accepted unless agreement to the changes and any additional charges has given in writing.

9. Individual Prints

Individual prints and framed prints are not included in this contract but are available at extra cost on request. 

10. Reorders

All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.

11. Copyright

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act for you to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the written permission of The Photographers.

12. Artistic Licence

The Photographers shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographers judgement regarding the locations/poses and number of images taken shall be deemed correct. You will provide the Photographers with a full list of group shots required (including names where appropriate) at least two weeks before the wedding. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.

13. Force majeure or Act of God

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

14. Attendance

In the unlikely event of the assigned Photographers being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his/her best ability. The appointed photographer will be a professional photographer with proven experience of wedding photography

15. Limitation of Liability

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

16. Cancellation

The Client may cancel this contract at any time by giving written notice to The Photographer/s but in doing so shall forfeit any monies paid. Cancellation less than 12 weeks before the wedding will result in the payment in full.

17. Negatives/Digital Files

Negatives / digital files remain the property of The Photographers. The Photographers grant by means of this contract a licence for the Bride & Groom to use the copies of the images used in the wedding album for their personal use, including printing and posting on social media. The licence does not include the right to copy and/or distribution the digital images or the right to distribute prints. The licence does not include the use of any of the images for commercial gain.

18. Prices

All prices quoted are inclusive of V.A.T. at the current rate.

19. Complaints

Any complaints should first be raised by the Client with the Photographer/s in writing within 21 days from the date of receipt of images. In the unlikely event of an unresolved complaint the Client may request the Society of Wedding and Portrait Photographers to mediate but only on the basis that its decision shall be final and binding upon both parties.
